The Allied Peoples Movement (APM)’s challenge of the results of the 2023 presidential election has been delayed till Friday by the Presidential Election Petition Court (PEPC) in Abuja.
The petition from the APM had earlier been bundled with those from Mr. Peter Obi of the Labour Party (LP) and Alhaji Atiku Abubakar of the Peoples Democratic Party (PDP). However, the APM’s case was put on hold at the hearing on Tuesday.
This was brought about by a recent Supreme Court ruling that President Asiwaju Bola Tinubu’s legal counsel brought to the court’s attention. The APM is challenging Tinubu’s election victory as president.
Breaking: Tinubu Seeks Dismissal Of APM’s Petition, Says It Lacks Merit
Chief Wole Olanipekun, Tinubu’s attorney, stated that the Supreme Court had recently addressed the APM’s single allegation that Vice President Kashim Shettima had been nominated twice prior to the presidential election.
“In this wise my lords, this particular petition which has just been called in respect of which the sole issue that is being ventilated is the nomination of the 1st Respondent who we represent,” Olanipekun explained.
“We promise that within the next two days, certified true copies of the judgement will be made available.”
Mr. S.A.T. Abubakar, the attorney for the APM, asked for a postponement so that he could review the Supreme Court’s ruling.
Prince Lateef Fagbemi and Mr. Abubakar Mahmood, the legal counsel for the APC and the Independent National Electoral Commission, respectively, did not object to the request for a postponement.
UPDATE: Presidential Tribunal To Take PDP, APM’s Petition On Tuesday
As a result, the panel, presided over by Justice Haruna Tsammani, decided to put off the proceedings until Friday.
According to the APM’s appeal, Tinubu’s campaign was ineligible to run for office under Sections 131(c) and 142 of the 1999 Constitution as a result of Mr. Ibrahim Masari’s withdrawal as the initial Vice-Presidential candidate for the All Progressives Congress (APC).
The petition, which President Tinubu and the APC contend lacks merit, has been challenged in motions filed to do so.
The court has granted APM permission to present its suggested single witness in the meantime.
