Aisha Dahiru, better known as “Binani,” the Adamawa State governorship candidate in the March 18 gubernatorial election, has again sued the Independent National Electoral Commission, INEC, over the Commission’s nullification of her declaration as governor of the state.
Binani ran for governor of Adamawa on the platform of the All Progressives Congress, or APC.
According to NAN, Binani filed a new petition before Justice Donatus Okorowo of a Federal High Court in Abuja through her counsel, Michael Aondoaka, SAN.

She sued the INEC, the Peoples Democratic Party, and its candidate, Governor Ahmadu Fintiri, as the first, second, and third respondents in the ex-parte motion marked: FHC/ABJ/CS/935/2023.
Binani has asked the court for a judicial review of the electoral umpire’s decision to revoke her earlier declaration as the winner of the election by Hudu Yunusa-Ari, Adamawa State’s Resident Electoral Commissioner, REC.
On Monday, Aondoaka argued on behalf of Binani that the election petition tribunal was the only body with the authority to decide his client’s destiny under Section 149 of the Electoral Act, 2022.
He claimed that INEC’s decision would deprive Binani of Section 285(6), which provides 180 days for the tribunal to dismiss her case filed on May 6.

Although a similar complaint had previously been brought before Justice Inyang Ekwo, the sister court instructed Binani to contact a tribunal for her suit because it is an election-related subject.
As a result, he requested that the INEC’s action be reviewed.
He stated that an undertaking had been signed to demonstrate to the court that the current complaint was not frivolous and that they were willing to bear any costs if the court determined that the lawsuit was frivolous.
After hearing from Andoaka, Justice Okorowo decided not to rule on the case.
